Sub-Contracting Cases

Not all public defenders engage in this practice, however, the ones that do are part of the cause of this epidemic. Many public defenders are sub-contracting cases to other attorneys to maximize revenue. Some convictions have been overturned because the legal representation was deemed ineffective or incompetent.

Overwhelming Case Load

Because of the overwhelming number of cases, public defenders cannot possibly handle the load and many cases end up “taking a plea of guilty for a lesser sentence” rather than going to trial to try to prove innocence.

Public defenders simply do not have the time or the help to handle the number of cases they are confronted with. So more people end up in prison because of the massive weight of the system.
